TERMS AND CONDITIONS
1. A non refundable deposit of £350 is required & must be sent with the booking / insurance indemnity form.
2. The balance of the Tour price is due 8 weeks prior to the departure date.
Should this payment fail to reach us by the date specified, we retain the right to treat the booking as cancelled & retain the deposit.
When a booking is made within 8 weeks of the departure date then a booking is confirmed on receipt of the total cost of the holiday.
3. You may cancel your booking at any stage provided you do so in writing. To protect yourself against this eventuality you should ensure that you purchase travel insurance at the time of booking.
The date on which the letter is received by us will determine the date that the cancellation is applicable.
4. The following cancellation charges are expressed as a percentage of the total Tour price and are as follows:
70-43 days before departure 50% of total tour cost
42-29 days before departure 75% of total tour cost
28 days or less before departure 100% of total tour cost
5. The receipt of the deposit does not imply acceptance of the booking.
We will confirm our receipt & acceptance of your booking in writing & send out this confirmation that a contract comes into existence between us.
6. On all trips you will normally be allocated a Luxury Double Cabin. The Deluxe Nile View Suite is available on request at an additional fee on a first come first serve basis. A waiting list will be avaliable in the event of the Deluxe Nile View Suite becoming available due to a cancellation on a first come first serve basis.
7. Atelier Egypt reserves the right to alter or cancel any holiday.
Should an alteration or cancellation become necessary you will receive a letter to notify you offering you an acceptance of the change or the offer of taking an alternative holiday date subject to availability or accepting a refund of all monies paid to Atelier Egypt.
8. For avoidance of doubt, Atelier Egypt is not party to any flight bookings you make in conjunction of your Tour and will receive no payment for the same, we will therefore not refund the costs of your flight in the event of a holiday cancellation.
9. Notification of the clients flight details must be given to Atelier Egypt
no later than 28 days before departure.
10. You may change your booking up to 30 days before the date of departure by transferring it to another person if you are unavoidably prevented from travelling. The transferee will then be liable for any outstanding costs that may apply to the booking.
The right to transfer will be subject to a 50 administration fee.
11. Underbooking is the situation in which the minimum number of bookings required to run the tour is not met, and if we have to cancel, we will not do so less than 30 days prior to departure. We normally require 10 persons per trip out of a possible maximum capacity of 18 persons to make a trip. We will however accept the equivalent total booking fee for 10 persons should the trip remain underbooked / should the client wish to book the boat privately.In all matters of booking the boat privately / for private function the final fee will be at the discretion of Atelier Egypt & Mohammed El Saidi.
12. Force Majeur is unusual & unforeseen circumstances beyond our control such as war, or threat of war, riots, terrorist activity, civil strife, fire, flood or adverse weather conditions, levels of water in rivers or other similar conditions out of our control.
13. Changes may be deemed to be major of minor changes:
~a major change is defined as a change to accommodations of a lower rating for all your Tour or a change in holiday dates
We will advise you as soon a possible and we will give you the following
options:
- Acceptance of the new arrangements
- Take an alternative Tour date subject to availability
- Withdraw and accept a full refund of all monies paid
~a minor change is deemed to be any change that is not defined as a major change
14. Should the Foreign Office advise against visiting Egypt, we shall immediately take a refund of all monies paid to Atelier Egypt.
15. We reserve the right to change any of the prices, service or other particulars contained in the brochure at any time before we enter in to a contract with you.
If there is any change, we will notify you before we enter into such a contract.
16. If you have special dietary requirements or other requests you should inform us of these prior to departure. We will advise the supplier of these services of your requirements, but cannot guarantee that these requests will be met, and will have no liability to you if such requests are not met.
17. The Tour that we offer requires flexibility and must allow for alternatives.
For this reason the outline for the holiday is taken as an indication of what may take place on the holiday, and not as a contractural obligation on the part of the Atelier Egypt.
18. Atelier Egypt does not accept responsibility for any loss or additional expense caused by delay or interruption to the travel service through adverse conditions, civil disturbance, industrial action, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the passenger.
19. Atelier Egypt accepts responsibility for acts and/or omissions of its employees whilst acting in the course of their employment and does not take responsibility or liability for death, bodily injury or illness caused by the client or any other person included in the Tour unless arising from the negligent act and/or omission of Atelier Egypts employees. Whilst acting in the course of their employment they shall be subject to English law in respect of any question of liability or quantum, and all proceedings shall be within the exclusive jurisdiction of the English courts.
20. Atelier Egypt acts only as an agent for the owners, & suppliers of transport and the local agents / operators, and other related travel services provided and assume no liability or responsibility for additional expenses howsoever caused arising directly or indirectly from the actions or omissions of such suppliers or their employees whilst acting in the course of their employment on the Tour. Atelier Egypt has no liability for the actions either of any independent parties accidents, loss or damage to persons or property, delays, transport failures, strikes, wars, Force Majeur, acts of God etc, over which the company has no control.
21. The client must communicate any perceived failure in the performance of this contract immediately to the tour leader / boat manager thus giving Atelier Egypt the opportunity to achieve a satisfactory solution. Should this not be possible, then you should make your complaint known to us in writing on the completion of the holiday or within 7 days of the completion of the holiday.
22. It is a term of the contract between us that you will obtain the appropriate travel insurance cover before you set out on the holiday.
The insurance must cover the loss, expenses and damages arising from, including but not limited to the duration of the Tour (whether in whole or part), personal accident and injury, medical and repatriation costs, loss of personal money and belongings and flights cancellations and delays.
23. All clients must be in possession of a valid passport and a valid visa for entry into Egypt .Visas can be obtained on entry at Luxor Airport, and can be paid for in Sterling. We advise for your convenience that all visas be obtained in advance of departure at The Egyptian Embassy, 2 Lowndes Street, London.

24. Clients must also be possession of all permits and certificates, including medical certificates requiring permission to take the journey and the client accepts responsibility for obtaining the same.
25. In the unlikely event that we become unable to provide a signicant proportion of the services you have booked after your departure. We will endeavour to provide alternative arrangements for you at no extra cost, if this is impossible, we will provide you with transportation back to the point of your holiday destination, and a pro rata refund for the costing of the remainder of your holiday .
26. A tip of £5 per day is chargable (£35 per trip) for service and can be payable on completion of the cruise.
27. By signing the booking form you are agreeing to accept all the above conditions. The person who signs the booking form does so on behalf of the individuals included on it, so that they are all bound by the booking conditions.
28. Atelier Egypt reserves the right to decline any booking.
